Terms and Conditions

This website, joegoodreau.com (the “Website”), and all of its Content are owned and operated by J. Goodreau Coaching, LLC, a Vermont limited liability company (“Company,” “we,” “us,” or “our”). The terms “you” and “your” refer to any person who visits, uses, or makes a purchase through the Website, including a Parent or Guardian (defined below) who registers or purchases on behalf of an Athlete (defined below).

These Terms and Conditions (“Terms”) govern your use of the Website and of the programs, courses, coaching sessions, and other products and services we offer through it, including the MRT Program, the 24-Day MRT Course, and MRT Intensive 1:1 sessions (together, the “Services”). Our Privacy Policy and our Disclaimer, both posted on this Website, are part of these Terms and are incorporated by reference.

By using the Website, creating an account, registering for any free offer, or making a purchase, you agree to these Terms. If you do not agree, please do not use the Website or the Services.

Where We Offer Our Services

The Website and the Services are intended for, and offered only to, residents of the United States. By creating an account or making a purchase, you confirm that you live in the United States. If we learn that a purchase was made by someone living outside the United States, we may cancel it and refund the amount paid.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this Website and change the “Last Updated” date below. If we make a material change, we will also notify registered customers by email or by a prominent notice on the Website. Updated Terms apply from the date they are posted and do not change the terms of any purchase completed before that date. Your continued use of the Website after changes are posted means you accept the updated Terms.

Eligibility, Minors, and Parent or Guardian Consent

The Website is intended for adults, including parents and legal guardians acting on behalf of their children. You must be at least 18 years old, or the age of majority in your state, to create an account, submit information, register for any free offer, or make a purchase.

Children Under 13. The Website is not directed to children under 13. Children under 13 may not create an account, register for any free or paid offer, submit a form, or provide any personal information through the Website. If we learn that we have collected personal information from a child under 13, we will delete it as described in our Privacy Policy.

Athletes Ages 13 to 17. An athlete between 13 and 17 years old (an “Athlete”) may use course materials and take part in coaching sessions only through an account created, and a purchase made, by the Athlete’s parent or legal guardian (a “Parent or Guardian”), and only under that Parent or Guardian’s supervision.

Your Responsibility as a Parent or Guardian. By registering or purchasing on behalf of an Athlete, you represent that you are the Athlete’s parent or legal guardian, you accept these Terms on the Athlete’s behalf and on your own behalf, and you are responsible for the Athlete’s use of the Website and the Services.

Website Use

The words, design, layout, graphics, photos, images, videos, audio, workbooks, course materials, information, documents, data, and all other information and intellectual property available on or through this Website (“Content”) are our property or the property of our licensors and are protected by United States and international intellectual property laws.

If you enter into a separate written agreement with us, such as an agreement for a speaking engagement, team consulting, or a custom team program, that agreement governs those services and will control if it conflicts with these Terms.

Intellectual Property Rights

Our Limited License to You. This Website and its Content are owned by us, our affiliates, or our licensors, unless otherwise noted, and are protected by copyright, trademark, and other intellectual property laws. When you view, access, or purchase any Content, we grant you a limited, revocable, non-exclusive, non-transferable license to use it for personal, non-commercial purposes only. For a purchased course or program, this license covers the purchasing Parent or Guardian and the Athlete named on the account, within a single household.

You understand that our Website and its Content were developed through significant time, effort, and expense, and that they are valuable assets we are entitled to protect. When you access or purchase any Content, you agree that:

  • You will not copy, reproduce, record, or distribute our Website or Content except as these Terms allow.
  • You may download or print one copy of individual pages or materials for your own personal, non-commercial use, provided you keep all copyright, trademark, and other proprietary notices intact.
  • You will not share your account login, or share course videos, workbooks, or other paid materials, with teammates, other families, teams, clubs, schools, or anyone outside your household.
  • You will not claim, imply, or represent that our Content is yours or was created by you. Downloading, printing, or using our Content does not give you any ownership rights in it.
  • You must have our written permission before using any Content for business or commercial purposes, including coaching, teaching, or training others, or before modifying, republishing, translating, selling, creating derivative works from, or distributing any Content in any medium.

MRT™, MRT Code™, Mindset Readiness Training™, the 24-Day MRT Course™, our taglines, and the other names and logos displayed on the Website are our trademarks unless otherwise noted. You may not use them, including in meta tags, domain names, social media handles, or other text, without our written permission.

All rights not expressly granted in these Terms or in a separate written license are reserved by us.

Your License to Us. If you submit or post any material to us or through the Website, such as a testimonial, comment, photo, or video (a “Submission”), you represent that you own it or have the right to share it, and that you are at least 18 years old. A Submission that includes an Athlete’s name, image, or words may be made only by that Athlete’s Parent or Guardian.

You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, edit for length and clarity, and display your Submission on the Website and in our marketing materials. We will identify you or an Athlete by name only with your consent. We are not required to use any Submission. You may ask us to stop using a Submission at any time by emailing [email protected], and we will remove it from the Website within a reasonable time. We cannot recall materials that were already printed or distributed before your request.

Request for Permission to Use Content

Any request for written permission to use our Content should be made before you use it, by emailing [email protected].

If we grant permission, you agree to use only the specific Content we approve, and only in the ways we approve in writing. Any other use is a violation of these Terms and of our intellectual property rights, and you agree to stop that use immediately when asked and to take reasonable steps we request to correct it.

Copyright Complaints (DMCA)

We respect the intellectual property rights of others. If you believe Content on this Website infringes a copyright you own, you or your authorized agent may send a notice to [email protected] that includes: (1) your signature; (2) a description of the copyrighted work; (3) a description of the material you believe is infringing and where it appears on the Website; (4) your name, address, phone number, and email; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Accounts

Some Services require an account. You agree to provide accurate information, to keep your login credentials confidential, and to notify us promptly at [email protected] if you believe your account has been used without your permission. You are responsible for all activity under your account, including activity by an Athlete using your account.

Purchases, Pricing, and Payment

Prices are listed in U.S. dollars unless otherwise stated and do not include any taxes that may apply. Payments are processed by third-party payment processors, including Stripe and PayPal, through our website platform, Kajabi. We do not receive or store your full card number. By making a purchase, you confirm that you are authorized to use the payment method you provide.

We may change our prices or offers at any time. Price changes do not affect purchases already completed. If a product or service is listed at an incorrect price because of an error, we may cancel the order and refund any amount you paid.

Refund and Cancellation Policy

24-Day MRT Course: 30-Day Money-Back Guarantee. If you are not satisfied with the 24-Day MRT Course for any reason, you may request a full refund within 30 days of your purchase date. No explanation is required.

  • Refund requests must be emailed to [email protected] within 30 days of purchase and should include the name and email address used for the purchase.
  • Approved refunds are issued to the original payment method, typically within 10 business days.
  • Access to the course ends when the refund is processed.
  • The guarantee is limited to one refund per customer or household.

MRT Intensive 1:1 Sessions. You may cancel or reschedule a session for a full refund or a new session time by giving at least 48 hours’ notice before the scheduled start time. Cancellations made with less than 48 hours’ notice, and missed sessions (“no-shows”), forfeit the session and are not refundable. Completed sessions are not refundable. We may waive this policy at our sole discretion in cases of emergency or illness; a waiver in one case does not create an obligation to waive it in another. If we need to cancel or reschedule a session, we will offer you a new time or a full refund for that session, at your choice.

Speaking, Team Consulting, and Custom Team Programs. These services are governed by the cancellation and refund terms of the separate written agreement for each engagement, not by this policy.

Payment Disputes. If you have a problem with a charge, please contact us at [email protected] before filing a dispute with your bank or card issuer so we can try to resolve it quickly.

Coaching Sessions and Scheduling

Coaching sessions are booked through Calendly, a third-party scheduling service, and may be delivered virtually or in person. Please use scheduling forms only for scheduling details and your goals for the session. Do not submit medical, health, or mental health information through scheduling forms.

For an Athlete under 18, the Parent or Guardian must approve each coaching engagement, and may attend or observe sessions.

Coaching conversations are treated as private, with important limits. If an Athlete shares information suggesting a risk of harm to themselves or others, or suggesting abuse or neglect, we may share that information with the Athlete’s Parent or Guardian and, where required or appropriate, with emergency services or the proper authorities.

Our coaching is mental performance education and coaching. It is not therapy, counseling, or medical care. Please read our Disclaimer for more information.

Personal Responsibility and Assumption of Risk

You agree that you are using your own judgment in using our Website, its Content, and the Services, and that you do so at your own risk. The Website, its Content, and the Services are intended to provide education and tools to help you and your Athlete make your own decisions. You are responsible for your own actions, decisions, and results, and a Parent or Guardian is responsible for supervising the Athlete’s use of the Services.

Athletic training and competition carry inherent risks of physical injury. Any suggestions we make about training, routines, sleep, nutrition, or other habits are general in nature. You should consult a physician before making changes to training, nutrition, or sleep routines, and you assume the risks of those changes.

Disclaimer

Our Website, its Content, and the Services are for informational and educational purposes only.

Not Medical or Mental Health Advice. Our Website, Content, and Services are not medical advice, mental health advice, therapy, or counseling, and are not a substitute for diagnosis or treatment by a physician, psychologist, counselor, licensed dietitian, or other licensed health care professional. We are not licensed health care or mental health professionals. Do not disregard professional advice or delay seeking it because of anything you read on this Website or receive from us. If you or your Athlete may have a medical or mental health concern, contact a licensed health care provider promptly. In a crisis in the United States, call or text 988, or call 911 in an emergency.

No Guarantee of Results. We do not guarantee any particular result from using our Website, Content, or Services, including improved performance, playing time, roster selection, college recruitment, or scholarships. Results differ for each individual. Testimonials and examples of athletes we have worked with, including college placements, reflect those athletes’ own effort and circumstances and are not typical or guaranteed results.

Warranties Disclaimer. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE, CONTENT, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE OR ITS CONTENT WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NOTHING IN THESE TERMS LIMITS ANY WARRANTY OR RIGHT THAT CANNOT BE EXCLUDED UNDER THE LAW THAT APPLIES TO YOU.

Technology Disclaimer. We work to keep the Website and its Content available and working properly. However, access may be suspended or limited from time to time, including for repairs, maintenance, or updates, or because of problems with our platform providers or the internet. We will try to limit the frequency and length of any interruption. Temporary unavailability does not entitle you to a refund, except as stated in our Refund and Cancellation Policy.

Errors and Omissions. We make every effort to present accurate, up-to-date information. Because research in sport psychology and mental performance continues to evolve, we cannot guarantee that all Content is complete, current, or free of errors, and we are not responsible for errors or omissions in the Content or in information linked from it.

Links to Other Websites. The Website may include links to websites run by third parties. These links are provided for convenience only and do not mean we endorse or are responsible for those websites, their content, or their privacy practices. Please review the terms and privacy policies of any linked website you visit.

Limitations on Linking and Framing. You may link to our Website as long as the link does not state or imply any sponsorship or endorsement by us. You may not frame or inline link our Content without our written permission.

By using our Website, its Content, or the Services, you also agree to our full Disclaimer, which is posted on this Website.

Indemnification and Limitation of Liability

Indemnification. You agree to defend, indemnify, and hold harmless the Company and its owners, employees, contractors, and agents from and against any claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of (1) your breach of these Terms, (2) your misuse of the Website, Content, or Services, (3) your violation of any law or the rights of any third party, or (4) any Submission you provide. If you are a Parent or Guardian, this includes the Athlete’s use of the Website and Services under your account.

Limitation of Liability. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost opportunities, or lost data, arising out of or related to the Website, its Content, or the Services, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Website, its Content, or the Services will not exceed the total amount you paid us in the 12 months before the event giving rise to the claim.

Exceptions. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for our gross negligence or willful misconduct.

Your Conduct

You agree not to use the Website or its Content in any way that causes, or is likely to cause, the Website, Content, or access to them to be interrupted, damaged, or impaired. You are responsible for all communications and content you send to us or through the Website.

You agree to make purchases only for yourself or for an Athlete for whom you are the Parent or Guardian, and you are financially responsible for all purchases made through your account. You agree to use the Website and its Content only for lawful, personal, non-commercial purposes. You agree that you will not use the Website or its Content:

  • For fraudulent purposes or in connection with any unlawful activity
  • To send, post, or share material that is illegal, offensive, abusive, harassing, defamatory, obscene, threatening, invasive of privacy, or that infringes anyone’s intellectual property rights
  • To introduce viruses or other harmful code, or to send spam, chain letters, or unsolicited commercial messages
  • To impersonate any person or misrepresent the source of any Submission
  • To share account access, or to reproduce, copy, resell, or distribute any part of the Website or its Content except as these Terms allow

Third-Party Services

We use third-party service providers to operate the Website and deliver the Services, including Kajabi (website, course hosting, accounts, and email), Stripe and PayPal (payment processing), and Calendly (scheduling). When you use these services through our Website, you may also be subject to their terms and privacy policies. We are not responsible for the independent practices of these providers. Please see our Privacy Policy for how information is shared with them.

Termination

We may suspend or end your access to the Website, its Content, or the Services, in whole or in part, if you violate these Terms, including by sharing account access or paid materials. If we end your access for a violation of these Terms, you are not entitled to a refund. If we end your access for any other reason, we will refund the amount you paid for the affected Service. The provisions of these Terms that by their nature should continue, including those on intellectual property, disclaimers, indemnification, limitation of liability, and dispute resolution, will continue to apply after termination.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Vermont, without regard to its conflict of law rules.

If you have a dispute with us, please contact us first at [email protected]. We will try in good faith to resolve it informally within 30 days.

If we cannot resolve a dispute informally, you and we agree that any legal action will be brought only in the state courts located in Chittenden County, Vermont, or in the United States District Court for the District of Vermont, and both parties consent to the jurisdiction of those courts. Either party may instead bring an individual claim in small claims court if the claim qualifies.

General Terms

These Terms, together with our Privacy Policy, our Disclaimer, and any separate written agreement with us, are the entire agreement between you and us about the Website and the Services. If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later. You may not transfer your rights under these Terms without our written consent. We are not responsible for delays or failures caused by events beyond our reasonable control. You agree that we may communicate with you electronically, and that electronic communications satisfy any requirement that communications be in writing.
